Farmer / Farmers Market

There are certain food items that can be produced on a farm and sold from the farm and be exempt from any type of food license and inspections. These certain items can be sold at a Farm Market. A Farm Market is when an individual:

• grows and cultivates produce and sells that unprocessed produce at their farm.
• has less than 500 hens, then the eggs from those hens can only be sold at their farm.
• makes cottage food items like jams, jellies, candy, and non-potentially hazardous (shelf stable) baked goods and sells these items at their farm. Proper labeling is required. ( see Cottage Foods)
• makes maple syrup, sorghum, and honey and sells these items at their farm. Proper labeling is required. ( see Cottage Foods)
• raises and slaughters no more than 1000 chickens, and those dressed chickens can be sold at their farm.

If these items are sold at a Farm Market, the Farm Market must register with the Ohio Department of Agriculture to receive the exemption. Registration does not cost anything. Go to Ohio Department of Agriculture .

• unprocessed produce.
• Cottage Foods like jams, jellies, non-potentially hazardous (shelf stable) bakery items etc. that are properly labeled.
• commercially prepackaged food that is non-potentially hazardous and the display is less than 100 cubic feet.

If these items are sold at a Farmers’s Market, the Farmer’s Market must register with the Ohio Department of Agriculture to receive the exemption. Registration does not cost anything. Go to Ohio Department of Agriculture.
Eggs, meat, poultry, and dairy products sold at a Farmer’s Market require licensing and inspections from the Ohio Department of Agriculture and local health departments.
